Orange County Child Support Calculation

How is Child Support Calculated in Orange County?

In Orange County and in the State of California there are specific guidelines about how child support can and should be calculated. However, it is only a guideline because in the State of California the judge has the final say as to the amount of child support ordered.  For that reason, it is advisable to consider hiring an experienced Orange County child support attorney who may look at your specific case objectively and thoroughly.  Attorney Marc E. Mitzner has the experience and knows to help you in any child support matter.

To give you a general idea of how child support is calculated we offer the following information. This may give you a general idea of the factors that will be considered in your case and what is needed to calculate your child support decree.

These factors usually include:

  • The needs of the child: day care, special needs, education, health insurance
  • The income and needs of the custodial parent
  • The paying parent's ability to pay based on income, properties, bonuses and services available
  • The child's standard of living prior to the divorce or separation

The Court will require financial statements and documentation to back those statements where each parent must detail their monthly income and monthly expenses. The Court also looks to consider the standard of living to which the child or children were accustomed prior to the divorce and it attempts to continue that standard for the children if possible. The Courts do recognize, however, the burden of maintaining two separate households on the income that formerly supported one home.

These are some but not all of the questions which will be asked and the documentation that will be necessary to submit. Getting child custody can be a subjective matter before a judge. That is why it is highly advisable to have legal representation who can present your facts for you in the most optimum, professional way.

If you have any questions about the child support guidelines or questions concerning getting child support, contact us for a free initial consultation.  At that time the specifics of your case can be discussed and evaluated by a qualified, experienced Orange County child custody attorney.
